⚖️ What’s the Difference?
Under Polish law, there are two main options:
- No-fault divorce – the court does not assign blame to either spouse.
- Fault-based divorce – the court finds one or both spouses responsible for the marriage breakdown.
✅ When Is No-Fault Divorce the Better Option?
If:
- you want to end the marriage quickly and efficiently,
- you’re not interested in assigning blame,
- you agree on child-related matters (or don’t have children),
- both parties consent to the divorce –
then a no-fault divorce is usually the simplest path.
Benefits:
- one hearing may be enough,
- remote participation is more likely to be accepted by the court,
- no need to provide proof of misconduct,
- less stress and lower legal fees.
This approach is particularly useful for people living abroad, who can’t easily travel to Poland for multiple hearings.
❗ When Might a Fault-Based Divorce Be Worth It?
It may be worth pursuing fault-based divorce if:
- you want to prove serious misconduct (e.g. infidelity, abuse, alcoholism),
- you feel it’s important morally or emotionally,
- you plan to seek spousal support, as the at-fault spouse may be required to pay.
Drawbacks:
- the process is longer and more confrontational,
- your personal attendance at court may be required,
- you’ll need to provide proof (documents, witnesses, etc.),
- it’s more stressful and complex.
🌍 What’s Better If You Live Abroad?
