The answer is: yes – but only if the Polish court still has jurisdiction.

⚖️ Should the Case Be Handled in Poland or the UK?

It depends mainly on where the child’s habitual residence is and how long they have lived there.

✅ If the child recently moved to the UK and previously lived in Poland – the Polish court may still have jurisdiction.

❌ If the child has lived in the UK for more than six months, and their life is now based there – the UK court will likely have jurisdiction.

That’s why it’s important to act quickly – the sooner you start, the more likely the matter can be resolved in Poland.

If the Polish court accepts jurisdiction, it can rule on:

  • the child’s place of residence,
  • parental authority (custody),
  • limiting or suspending parental rights of the other parent,
  • visitation/contact schedule,
  • return of the child, if they were taken abroad without consent.

  • child’s birth certificate,
  • proof of Polish citizenship (parent or child),
  • documents showing the child previously lived in Poland,
  • current address of the child,
  • power of attorney for legal representation in Poland.
