⚖️ Is Attending the Hearing Mandatory?
Yes. In a Polish divorce case, both spouses must be questioned by the court. This is essential for the court to determine whether the marriage has irretrievably broken down.
However, that does not mean you have to fly to Poland. Increasingly, Polish courts allow remote hearings via video conference (usually through MS Teams), if technical and legal conditions are met.

Remote participation is possible if:
- a proper motion is submitted to the court,
- the judge finds no legal or practical obstacles,
- you have access to a camera, microphone, and stable internet,
- there is no need for direct confrontation (with your spouse or witnesses).
Remote hearings are most commonly approved when:
- the divorce is no-fault,
- both parties agree to the divorce,
- there are no disputes over children,
- both spouses live abroad.
📝 What Does the Motion Look Like?

- confirmation that you live in the UK,
- explanation of why personal attendance is difficult,
- technical details for video access.
The motion should ideally be submitted at the beginning of the case — even with the divorce petition.
❗ Will the Court Always Approve It?
No — it’s up to the judge. Some courts are flexible and routinely allow remote hearings. Others may insist on in-person testimony.
